Instruction to F-Power Inc. by the Organization

Organization for Cross-regional Coordination of Transmission Operators, JAPAN (hereinafter, the Organization) more severely monitors supply-demand status based on discussion at the national council in cooperation with Agency for Natural Reseources and Energy, and Electricity and Gas Market Surveillance Commission.

The Organization would like to inform you that the Organization gave instruction to F-Power Inc. according to the provision of paragraph 1 of Article 179 of the Operational Rules on August 25. In addition, the Organization has reported the action for the securing stable electricity supply (including this instruction) under 30 minuites’ balancing system of planned values to the Minister of Economy, Trade, and Industry, and requested to continue the discussion and take actions in timely and proper manner for the issue that is discussed at the national council.

  1. The Name of Electric Power Supplier subject to Instruction
    F-Power Inc.
  2. Summary of the Incident
    [1] F-Power Inc. (hereinafter, the Company) has frequently submitted improper demand and procurement plans which were deviated far from the rational demand forecast in several regional service areas from Apr. 1 to Jun. 30, 2017, and repeatedly made the supply for the demand imbalanced1 ; those were improper business activities in light of the Network Codes of the Organization. (Please see the Table 1 of the attached sheet).
    [2] Further, the Company has made the shortage of supply capacity in frequent and significant manner for the corresponding period and the areas2 . (Please see the Table 2 of the attached sheet).
    [3] The Organization gave instruction to the Company due to the improper business activities of the above. The regulating basis for the instruction is as follows. The improper activity of [1] corresponds to the regulation by the provision of item 7, paragraph 1 of Article 179 of the Operational Rules “When it is found that electric power suppliers conduct improper activities in light of laws and the Articles of Organization or these Rules or the Network Codes.” And that of [2] corresponds to the regulation by the provision of item 1 of the same paragraph and Article “when the members who are Retail Companies (including registered Specified Transmission, Distribution and Retail Companies) are not expected to secure proper supply capacity for demand in light of the past performance”, as considering the condition is difficult to promptly solve the shortage of supply capacity by the recurrence prevention measures submitted from the Company to the Organization.
  3. Contents of Instruction
    (1) The Company shall submit its demand plan to the Organization based on the rational demand forecast.
    (2) The Company shall submit its procurement plan with securing proper supply capacity to the Organization based on the above proper demand plan.
    (3) The Company shall make the balance between sales plan and procurement plan with demand plan matched for the submission of day-ahead and longer-period plans. If they are not matched, the Company shall explain the reasons to the Organization.
    (4) The Company shall secure adequate supply capacity for its demand at the real-time supply-demand in the regional service areas where it operates electric business.
    (5) The Company shall make full dissemination to all employees regarding the instruction above (1) to (4) and develop necessary and appropriate internal procedures for the compliance.
    (6) The Company shall report to the Organization for the implementing conditions regarding the instruction above (1) to (4), and the specific measures for the implementation of (5) by October 24, 2017.
    (7) The Company shall continuously report the implementing conditions regarding the instruction above (6) if the Organization recognizes its necessity.
